Duty to Read
You (herein referred to as "Purchaser") accept that you have a duty to read the shop policies of verveandspark.com/shop (herein referred to as "Shop"). Purchaser accepts responsibility for knowing and understanding these policies before making any purchases with Shop. Failure to do so does not invalidate Shop's policies. If you do not agree to these policies, please do not shop with us.
Changes to Policies
We reserve the right to modify or replace these Policies at our sole discretion. Any changes will be effective immediately upon posting. Your continued use of the Shop following the posting of changes constitutes acceptance of those changes.
PAYMENT & BILLING
Purchases
By purchasing any product, digital or physical, from Shop, Purchaser agrees to the following policies. In exchange, Shop agrees to provide the product/service identified in the online commerce shopping cart.
Fees
The cost of the items in Shop varies and could change at any time. Shop is not obligated to inform Purchaser of any changes. Price in cart at time of checkout will be the price that is charged to Purchaser. Full payment for items purchased in Shop is due at time of checkout. Sales and other discounts may be offered at various times, and Shop is not obligated to refund any money paid above the updated price if different from what the Purchaser paid at the time of checkout. If coupons were available, but Purchaser forgot to use them, Shop is not obligated to refund any money.
Methods of Payment
Payment can be made by credit card through Stripe or via PayPal. Shop is not responsible for the status of Purchasers financial status or account, such as late fees, overdraft fees, etc. Shop does not keep any financial information on hand, as all information is stored off-site in the third-party payment systems used during the transaction.
Memberships and Subscriptions
In the event that Purchaser has an ongoing charge for a membership or subscription, Shop will charge Purchaser via agreed upon payment method on the agreed date of renewal. To cancel a membership or subscription, Purchaser should give Shop at least 48 hours of notice to ensure cancellation goes through.
CANCELLATIONS & REFUNDS
Cancellation
Shipment times vary. If Purchaser needs to cancel purchase at any time before shipment, they must do so as soon as possible. If the items have already shipped, Purchaser is not eligible to cancel the order.
Custom items must be cancelled within 8 hours of purchase to be eligible for cancellation.
No cancellations can be made for digital products, as they are automatically sent upon completion of order.
All cancellations incur charges for processing fees, and only the purchase amount less fees will be refunded.
Refunds
Digital products are not eligible for a refund under any circumstances.
Memberships and subscriptions are not eligible for refunds, but can be cancelled before the next installment/payment.
For physical products that have been shipped and delivered, refunds are accepted, but with conditions. These include:
Returns/refunds must be initiated within a week of delivery.
Return delivery is the responsibility of the Purchaser in cases where Purchaser is not happy with the product for personal reasons.
Return delivery will be the responsibility of the Shop in cases where the item arrived damaged.
In all circumstances, Shop will work with Purchaser to ensure satisfaction with Shop and products to the best of Shop's ability, and Shop encourages communication in all cases.
Refunds will be made to the original purchase method. Refunds will always incur charges for processing fees, and only the purchase amount less fees will be refunded.
SHIPPING
Shop only ships to the 48 contiguous states, D.C., Alaska, and HI. If Purchaser is outside of this area, please contact Shop to see if special arrangements can be made to ship items to you.
Method of Shipping
Shop utilizes a shipping app to help find the best rates available. This determines who ships each package. Most of the time, it will be via USPS or UPS. Purchaser will get a shipping notification with tracking, which will let you know which method to expect.
USPS can take anywhere from 2-7 days depending on the method of shipping, which is determined by the rate of shipping.
Rates
Shop has 3 shipping rates available.
Digital products only will not incur any shipping. Once Purchaser adds physical products to the cart, shipping charges are triggered.
For packages that weigh 1/2 a pound or less, shipping will cost $4.50. This is Shop's cheapest rate and is usually sent via USPS.
For packages that weigh between 1/2 a pound and 1 pound, shipping will cost $6.50. This is Shop's mid-rate and can be send either USPS or UPS.
For packages that weight more than 1 pound, shipping will cost $10. This is our most expensive non-priority rate and can be sent either USPS or UPS.
Priority Mail Add-On
If Purchaser wishes to ensure your package arrives quickly, you can upgrade your package to priority mail, which will be sent by USPS Priority. These packages generally arrive in 2-3 days, but keep in mind distance - Shop is based in TX. This upgrade can be made by adding the 'Priority Mailing' product to your cart, and will be an additional $5 no matter your package size.
INTELLECTUAL PROPERTY
The content, materials, and intellectual property contained within each product in the Shop, including but not limited to text, images, graphics, audio, and video, are protected by copyright laws and international treaties. Verve & Spark retains all rights not expressly granted herein. This copyright notice applies worldwide.
Specific Digital Products
Depending on the digital product, it may come with its own terms of use. Those terms of use supercede those below and should be the governing terms for that product. This includes whether it is to be used for personal use purposes or whether it may include PLR or MRR rights.
PLR & MRR Rights
PLR stands for Private Label Rights and gives the Purchaser the right to modify the document for their own use. They can also reuse or resell it once it is modified.
MRR stands for Master Resell Rights and give the Purchaser the right to use and sell the products as is.
Most of Shop's digital products will be personal use only products, with some exceptions being PLR use. Each product will specify in its product description and in its downloaded materials.
Unauthorized Use
Unauthorized use includes, but is not limited to, reproduction on other websites, distribution through social media, modification, adaptation, or use for commercial purposes. Any such use without the prior written permission of Verve & Spark is strictly prohibited.
Permitted Uses
Certain noncommercial uses of this work may be allowed by copyright law. These uses include, but are not limited to, brief quotations for purposes such as:
critical reviews
commentary
news reporting
teaching
scholarship research
initiating client interest
However, these uses must comply with copyright law and be accompanied by proper attribution to Verve & Spark.
Third-Party Content
This work may contain trademarks or copyrighted material of third parties, which is used with permission or under fair use. Any such third-party content is subject to the rights and restrictions of the respective owners.
